PicHunts — Terms, Official Rules & Privacy Notice

1) Overview

This program powers photo scavenger hunts at in-person events. Players complete photo tasks; admins review submissions for compliance. Prize winners are chosen by random drawings held during the event (see Event Details on the event page for timing and prize info). No purchase necessary.

2) Promotion Period & Event Details

Each event has its own start/end times, drawing times, prize list with ARV, and AMOE location. These material terms appear in the Event Details panel at the bottom of the event page and are incorporated here by reference.

3) Eligibility

Open to legal residents of United States who are age 18+ or, for minors, have parent/guardian consent. Void where prohibited. We may require reasonable proof of eligibility/identity before awarding a prize.

4) How to Enter (two paths; limit 1 entry per person)

A) Play Path (tasks + approval). Scan the event QR and complete all required photo tasks before the posted deadlines. Admins will approve/deny each submission for compliance (e.g., "photo of a red car," not a blank image). Once all required tasks are approved, you become Eligible for the random drawings listed in Event Details.

B) AMOE — Alternate Method of Entry (free, no tasks). Submit a hand-printed card (about 3×5 inches) with your Name, Phone, and Email before each posted drawing time at the AMOE location shown in Event Details. AMOE entries are treated with equal dignity—same deadlines, prize pools, odds, and entry limits as the Play Path. We may reject illegible/incomplete entries or entries submitted outside posted windows.

5) Winner Selection, Odds & Notification

Rolling random drawings occur at the times listed in Event Details from among (i) all Eligible players and (ii) all timely AMOE entries. Odds depend on the number of eligible entries in each drawing. We may require winners to be present at drawing time or to respond within a short window (as listed in Event Details). Failure to respond/verify allows selection of an alternate. All admin decisions are final.

6) Prizes

See Event Details for the specific prizes and Approximate Retail Value (ARV) for each prize. Prizes are not transferable or redeemable for cash unless required by law. Taxes, if any, are the winner's responsibility.

7) Conduct & Technical Issues

Play respectfully and follow venue rules and the law. We aren't responsible for network failures, device issues, or third-party outages. We may cancel, modify, or suspend any drawing if technical or other issues compromise its integrity.

8) Photo Content & Publicity (UGC License)

You retain ownership of your photos. By submitting a photo, you grant Organizer and the event's named sponsors a non-exclusive, worldwide, royalty-free license to use, reproduce, adapt (for size/format), and publish your submission and name/likeness for event promotion and recap in any media, without further notice or payment. You can request removal from future marketing by emailing [email protected].

9) Privacy Notice

What we collect. Name, email, phone (if provided), photos you submit, basic device info (IP/timestamps), and event activity.

Why we collect it. To run the program, verify eligibility, contact winners, prevent fraud/abuse, and—only if you separately opt in elsewhere—send marketing updates.

Sharing. We use service providers to host, store, and email on our behalf. We may share aggregated stats with sponsors. We share your contact info with sponsors only if you explicitly opt in elsewhere.

Email rules. Any marketing email from us will include a working unsubscribe and our physical mailing address; we honor opt-out requests promptly.

Your choices. Request access/correction/deletion at [email protected]. We keep data only as long as needed and then delete/anonymize it on a reasonable schedule.

Children's Privacy. We don't knowingly collect personal information from children under 13 without verifiable parental consent. Parents can contact us at [email protected] to review or delete a child's information.

10) Organizer Responsibilities (for event hosts/coordinators)

By using PicHunts at your event, the Organizer agrees to:

  • Be solely responsible for event operations and safety, including crowd control, venue permissions, and compliance with applicable laws, rules, and venue policies.
  • Provide and fulfill all prizes (including ARV disclosures) and ensure prizes comply with applicable law.
  • Publish/maintain the Event Details on the event page (dates, prize/ARV, drawing times, AMOE location) and run drawings consistent with those details.
  • Obtain any required permits, insurance, and parent/guardian consents (if minors may participate).
  • Ensure any third-party trademarks, locations, or tasks used in the hunt are permitted by the rights holder or the venue.

11) Participant Assumption of Risk & Release

By participating, entrants acknowledge that attending in-person events may involve risks (e.g., crowds, outdoor conditions, moving around a venue) and agree to act responsibly and follow venue rules. To the fullest extent permitted by law, participants release and discharge PicHunts (and its owners, employees, and agents) from any claims or liability arising out of participation in the hunt or attendance at the event, except to the extent caused by PicHunts' willful misconduct or fraud.

12) Hold Harmless & Indemnification

12.1 Participant Indemnity. Participants agree to hold harmless, defend, and indemnify PicHunts and the Organizer from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from: (a) the participant's conduct at the event; (b) submitted photos/content (including alleged IP, privacy, or publicity violations); or (c) breach of these Terms.

12.2 Organizer Indemnity. Organizer agrees to hold harmless, defend, and indemnify PicHunts and its owners, employees, and agents from and against all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) the planning, promotion, or operation of the event (including crowd management, venue conditions, or staff actions); (b) prizes (including ARV statements, availability, fulfillment, and tax reporting); (c) Event Details accuracy and the conduct of drawings; (d) the AMOE process and physical handling/location of AMOE entries; (e) minors' participation and any required parental consents; and (f) Organizer's breach of these Terms or applicable law.

13) Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW:

(a) PIC HUNTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOST PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, EVEN IF ADVISED OF THE POSSIBILITY; and

(b) PIC HUNTS' TOTAL LIABILITY for any claim relating to a specific event will not exceed the greater of (i) the fees paid to PicHunts by the Organizer for that event, or (ii) USD $100.

Some jurisdictions do not allow certain exclusions/limits; in those places, this section applies to the maximum extent allowed.

14) Force Majeure

PicHunts and Organizer will not be liable for any delay, change, or cancellation caused by events beyond their reasonable control (including severe weather, power/network outages, strikes, acts of God, public health orders, or venue closures). If a drawing is affected, Organizer may reschedule or modify it in a manner that preserves fairness to entrants.

15) No Professional Advice; No Duty to Monitor

PicHunts provides a platform and templates only and does not provide legal or compliance advice. Organizer is responsible for ensuring the event, prizes, and disclosures comply with applicable laws and venue rules. PicHunts may—but has no obligation to—monitor content or entries.

16) Disputes & Miscellaneous

Subject to applicable law, disputes will be governed by the laws of State and handled in the state/federal courts located in County, State. If any provision is found invalid, the remainder remains in effect.
